ARCP
The ARCP is a public service expert in the development of Public-Private Partnership Contracts created by Decree No. 100/12 of January 6, 2016. It intervenes, jointly with the Contracting Authority, at all stages of a contract of public-private partnership, in particular during the preliminary evaluation of the PPP project, the selection of Co-contractors, the negotiation and monitoring of public-private partnership contracts. The pursuit of any partnership project and in particular the initiation of a procedure for selecting a partner is subject to the prior obtaining of a favorable opportunity opinion from the ARCP.

The Public-Private Partnership Contracts Support Agency guarantees the structural transformation of the national economy as reflected in the 2019 law on the General Regime of Public-Private Partnership Contracts.
The ARCP intervenes jointly with the contracting authority, at all stages of a public-private partnership contract, in particular during the prior assessment of the public-private partnership project, the selection of co-contractors, the negotiation and monitoring of PPP contracts. Moreover, this law increases the powers of the Agency by indicating that contracts concluded before the date of its promulgation are subject to evaluation and monitoring by the Agency.
The ARCP ensures compliance with the commitments of the parties to the public-private partnership contract from its signature, execution and closing. It informs the Government, through the sectoral ministries, of any violation of the contract or its possible imbalance, which could lead to a renegotiation of the contract. It is the interlocutor attracted between the parties to the PPP contract in all its phases.
